employment based green card

Post by ramaninsydney » Sun Aug 31, 2008 11:33 am

I am an indian born naturalized australian citizen.I want to move to usa on green card.I have an employer in USA who will sponsor me for green card.I know that it takes very long time for people of India, china and philpines to move to usa on employment based green card beause of their priority date is not current.I want to ask that how will my priority date be considered as an australian citizen.Do i have to wait in the long Inidan queue?.Will I have any advantage being an australian citizen, and my case will be be processed faster than Inidan?.

Thanks
Raman

You can't "move to the USA on a green card". You need to go on a work visa first, then your employer may petition for a green card for you. If you are an Australian citizen you can most likely use an E3 visa.

I do not want to get e3 visa beacuse its is a temporary visa and you have to come back after your work, i know e3 can be extended but still it is temporary visa..
i know that i have to get h1 visa first to move there and then i can apply for green card, but still my question has not been answered. How will be my priority date like will it be considered current like all the australians have current priority date or i have to stand in Indian queue.
thanks

Indian queue.

Unless perhaps you have parents or a spouse from another country.

Going in on an E3 is not the end of the world. You could also apply for the H-1B, thought it is more difficult to get. The government website states that you are eligible to change your status within the US while on the H-1B.

Also, I was reading the US website about the E3. It only states that you have to have the intent to return to Australia and show that. I couldn't find anything that says you can't switch to a new visa, only that you can't apply for an E3 while in the US. I would definitely double check.

Just keep in mind that the new fiscal year begins 1 October, so the closer you apply to that date the better chance you have since the number of visas given are reset to 65,000 for the H-1B.
