employment letter gone wrong

Hi all,

I am just in the process of renewing my husband's spouse visa and have just realised that it is due to expire on the 8th of December rather than in January as I first thought. Unfortunately we do not meet the financial requirement until January as waiting on 2 more payslips.

I have tried to see if I could get by using category b however because I was on maternity earlier this year, I had 2 months of unpaid leave off which means that we can't fulfil criteria.

My husband came to the UK on spouse visa in 2016 and we didn't renew after that as we were not together but then applied fresh in 2020 and were put on 10 year route.

Have I just made a mess of his application, what are the implications? Do I still put it through even though we don't have all paperwork or wait until Jan?

If it helps, we also have a daughter with special needs and receive DLA, if my husband was to be sent back - it would have a devastating effect on her.

On 10 year route, not meeting financial requirements is not an issue.

If you cannot meet the minimum income requirement
You need to show you and your partner meet the minimum income requirement if you want to settle in 5 years as a partner.

If you do not meet the requirement, you may be able to settle in 10 years.

When you do not need to meet the income requirement
You may be able to settle in 5 years without meeting the minimum income requirement if either:

you’re applying as a parent
you get certain benefits, for example Disability Living Allowance or Carer’s Allowance
You need to show you and your family have enough money to adequately support and accommodate yourselves without relying on public funds. The caseworker considers your income and housing costs.

Thank you for this. I did have a read of that. Does the DLA part apply only to applicant and partner or children too? The children are not part of the application as they are British citizens through me

We are just in process of renewing spouse visa for my Husband, he is on 10 year route because we were not able to fulfil financial requirement. We thought we would be able to this time but we are a few months short and visa is expiring in 3 days. Is this the right link to apply?

Hi,

Is there a requirement for the employment letter to be on letterhead paper? Also does a contract also need to be submitted for spouse visa renewal? My work have done my letter but not on letterhead paper and also not signed it

.They also refer to me by Miss not Mrs (even though they have been told many times- I work in local civil service) and have put my initial and surname as the addressee.

So I am assuming signature is a must but what about letter head paper? Also is a separate letter necessary for payslips authenticity or can be done on same letter?

What proof you need to give
You’ll need to provide proof of your income with your application. If you or your partner are employed, you could include:

bank statements showing you or your partner’s income
6 months of payslips
a letter from an employer, dated and on headed paper
The employer’s letter should confirm:

you or your partner are employed there
the job title or position you or your partner hold
how long you or your partner have worked there
the type of contract (for example, permanent, fixed term)
what you or your partner earn before tax and National Insurance
how long you or your partner have been paid your current salary
the payslips are genuine
