Entering the UK on almost expired passport

Post by applejuice123 » Fri Dec 23, 2022 10:50 pm

I have a foreign passport that's almost expired (<6 months), and I have an older, expired passport with indefinite leave to remain visa on it (not the BRP, but a indefinite leave to remain visa on the passport which is the system that precedes BRP), can I still enter to the UK?

UK's official policy seems to be 'You must have a valid passport to enter the UK. It should be valid for the whole of your stay.' according to https://www.gov.uk/uk-border-control/be ... for-the-uk but given my stay is 'indefinite' does the time left on the passport even matter?

Note the ILR being on an expired passport is not an issue and I've entered the UK with it in the past. See e.g. https://www.gov.uk/transfer-visa which says 'You can use the valid visa in your expired passport when you’re travelling to and from the UK. You’ll need to travel with your expired and your new passport.'

Yes. It tells you very clearly:
You can use the valid visa in your expired passport when you’re travelling to and from the UK. You’ll need to travel with your expired and your new passport.

You might have misunderstood my question. The issue is my current passport is about to expire (<6 months left), so would that prevent me from entering the UK? I already know I need to travel with my current passport and the expired passport with ILR on it.

No, short remaining validity is not a problem, you are a resident, not a temporary visitor, so you can enter the UK.

Thank you that makes sense.

Why are you using an old passport with an ILR stamp, to gain entry to the UK? According to a previous thread, you naturalised as Brtiish citizen via your parents.

If you have become a British citizen, keep in mind that your ILR is no longer valid. A British citizen can't hold ILR.

You should either apply for a British passport or a CoE-RoA in your foreign passport, if for some reason your other country does not recognise British passports.

Keep in mind that CoE-RoA is (a) much more expensive than a British passport and (b) it expires with the passport it is stamped in. So you would need to apply for a fresh CoE-RoA with every new foreign passport issued to you.
