Entry Clearance for my Son

Entry Clearance for my Son

I would appreciate you valuable advice to get an entry clearance for my son .
I am HSMP visa holder who entered UK in June 2004 under
the old HSMP Category . Initial after the entry clearance visa I was grant 3
years FLR and further on under the HSMP forum HC ruling I was granted another 3
years extension . So my HSMP visa will expire on MAR 2011 . In the meantime I
have applied & got my Indefinite Leave to Remain in the UK.
As of today i can see two types of Visa's on the passport.
a) Old HSMP extended visa valid Mar 2011
b) Indefinite leave to Remain .
The visa facilitation centre India says that I have to apply for a settlement visa since i have got my ILR now . My view is since my HSMP visa was extended to March 2011 I feel can apply for my son on the valid HSMP visa and the HC ruling where dependant's can join the primary applicant's Visa .
The other reason is the cost & time for the ILR for my son .
Entry clearance visa cost about 20K INR (£ 280 ) on the HSMP visa .
Settlement visa cost about 50K INR (£ 700 ) takes about 3 mths to process .
On the settlement visa my son will have to wait about 2 yrs to get his ILR whereas on the HSMP dependant's visa the ILR can be applied soon .
Please can you guide me on this .

You are no longer an HSMP migrant, but a person with settled status in the UK. Your son needs to apply for settlement visa, as advised by VFS. See also Family members (INF6) and Maintenance and accommodation (MAA).

How old is the child and where was he born? When were you granted ILR?
