EU3 Application: How early can one apply?

EU3 Application: How early can one apply?

Hi all,

I know the website states "If you are the holder of an EU1 Residence Card you will be eligible for a Permanent Residence Card if and when you have resided in the State in conformity with the Regulations for a continuous period of five years. As applications for a Permanent Residence Card can take up to six months to process, you should make an application for a Permanent Residence Card on Form EUTR3 six months before the expiry of your EU1 Residence Card"

Bearing in mind, the last time the website was updated was in 2016 and now factoring Covid delays, I can only reckon EU3 applications are going to taken longer than 6months.

My non-eu dependent's EUFAM expires in September 2021 though she is physically present in Ireland for over 5yrs.

The following are my questions:

- Is it safe to apply before March 2021?

- Has anyone submitted the EU3 application sooner in the past and got approvals?

I applied six months before expired as it stated on page and it took longer than 6 months before approval, and I saw your posts many topics related to non EU family of British citizens ,maybe it is a good idea to waiting for the finalise details from INIS what ways we have to go as I am currently hold permanent residence card and no idea what direction I have to go for. Received the letter from INIS stated that they will transfer me to domestic law automatically but in the link on the website seem I have to apply the status myself???

On the card is Stamp 4 EUFAM and on the outcome letter stated for 10 years.

So my understanding is you need to apply for WAB (Withdrawal Agreement Beneficiary) card online.

But there is an issue at the moment with the online system as per :

To check wheather my understanding is correct please review the following FAQs:

Q.9 What happens if I don’t apply?

A. After the 31 December 2020, your current EUFam card is no longer valid
and will not be accepted as proof of permission. Without a new Withdrawal
Agreement Beneficiary card you will not be in permission and thus will not
be able to claim your rights.

Q.10 Can I keep my current card?

A. After the 31 December 2020, your current EUFam card is no longer valid
and will not be accepted as proof of permission. Once you have applied for
and received your new IRP card showing you are benefiting from the
Withdrawal Agreement you should dispose of the EUFam card safely.

Yes,I have read that but it wasn't clear enough though as I am holding permanent residence before transition period end and this type of card is more like people whose still under 5 years of residency in Ireland,so maybe I should wait till the information or letter from INIS instruct of what direction we have to go for . Thank you for your info.

I know all the non-eu family members of UK Citizens who have applied or will apply EU3 would be getting Stamp 4 instead of Stamp 4 EUFAM.

Of course, please keep us posted how it goes n hope INIS sends you the instructions soon.
