Article 10 residence card: validity

Post by pashag » Mon Jul 20, 2020 3:10 pm

Hi folks,

I'd appreciate a little assistance in the following inquiry please.

My wife is a non-EEA citizen living in the UK. She has both an Article 10 residence card (issued by Germany) and now a 5 year British Residence Card (leave to remain).

If we visit France, is the Article 10 card still sufficient and valid, or will she need to apply for a Schengen visa? We are not sure if these rights carry on until 2020 of if they've already been withdrawn.

Thanks in advance.

Your Art 10 Aufenthaltskarte is no longer valid as neither of you are resident in Germany. It's nothing to do with Brexit.
Th question is whether your wifes LTR card will be seen as Article 10, and in my experience it will not. I would apply for a visa if I were you.
