Directive 2004/38/EC-Dependent Relative already living in EU

Hi,
I have a question and request fellow mates to share their valuable thoughts and understanding..

With regard to EU Directive 2004/38/EC, I have joined my sister living in Sweden already and due to change of her circumstances in her health conditions, she is u able to work and I am paying her rent and all expenses since a year..

My question is that would the dependency be considered and applicable under the directive as the directive says that a non-EU dependent family member join or accompany the EU members exercising their EU treaty rights?

In the above circumstances where the dependent sister is already residing in that particular EU state, and I join her there, would the directive be applicable in that scenario?
