EEA family member unmarried partner - travel to Germany

FIRST OF ALL apologies because I know this case was covered before but it is really confusing.

to make it Short: I am Italian and my boyfriend is Lybian. he has a EEA family member permit based on our durable relationship.
We are going to Berlin tomorrow and we had different opinion on the fact that we need to not a visa.
I called the embassy and they said no and then called again and said yes.
Same with the europa website. We have been twice to Italy and twice to Spain ( no problem) , he also travelled alone once
We really don't know what to do !!!!
Please anyone has a piece of document to share with us?

Does he hold 6 months family permit or 5 years residence card?

EU RP based on durable relationship is not recognised in Germany, however if your initial entry point to schengen is to a country which accepts it lets say Netherlands, then going to Germany on a forward flight or a train will have no immigration checks. However if you do get to Germany as your first point of entry they MIGHT ask questions and possibly deny entry.

How is possible to know which are the countries where this is accepted?

It is mostly the member states who are orthodox i.e. poland, romania, latvia, Lithuanian as well as germany etc. Its better to check the immigration website of the country you are trying to travel and see if under their national law if durable relationship is grounds for residence. generally if member states domestic law accepts durable relationship then it is bound to draw the same parallel under EU law.

The word "Orthodox" may be confusing in terms of faith in Eastern Europe. I suggest "conservative", with a lower-case c, may be more appropriate.
