Legal Advise Needed on Family Reunification in Denmark.

Legal Advise Needed on Family Reunification in Denmark.

We originate from S.E.Asia.

I'm a PR holder in Denmark for over 25 years. Wife too is a Danish PR holder of almost 20 years.

We have kids born here, literally with a 'Made in Denmark' label on their Danish birth certificates. Because we are not Danish citizen, kids are not Danish citizen by birth, but citizen of their parents' origin.

Because we wanted our kids to have a different education path, we sent them overseas once they reach schooling age with the intention of returning to Denmark once they completed their GCE 'O' Level before the age of 16/17.

To our horror the Danish Immigration reduced the age limit for kids from 18 to 15 years for family reunification. Demanding reunification application to be submitted before reaching 15.

So, we are in a predicament.... we can't have our kids back with the parents!!

Understands that international human rights convention states that anyone under the age of 18 is considered as minor.

In Denmark, the locals i.e. the danes, under 18 is considered as minor.

So, ain't this danish immigration law a discrimination against foreigner??

Has anyone same problem or experiences?

Anyone knows of any legal EU means of getting this rule petitioned and/or overruled?

Why have you not become Danish citizens, if you have lived so long in Denmark?

While, becoming a Danish citizen hasn't crossed our minds. There are no differences in rights of the locals and PR holders. Everyone is in the same basket, except for some minor priorities applicable to danes.

Maybe we should initiates the process. But that in itself won't resolve this 'family-breaking' immigration rule. One can understands if it is used for those not locally born. But, these kids of mine are born and raised locally.

Moreover, the general age as a minor in EU is 18 years, some members up to 21.

It seems to me that there are some quite significant differences between the rights of Danish citizens and PRs - notably the right to return to Denmark without restriction.

I cannot advise anything better than to find a good immigration lawyer in Denmark to discuss the options the children may have. If Denmark has a law for "returning residents" they may be able to get their PR back.
