Non EU Spouse Visa

Non EU Spouse Visa

Hi

I just got married to a non EU national. I'm a British citizen. Now I got a job opportunity in France. Will my wife have to join me in the UK first on a spouse visa followed by European spouse visa or can I directly apply for her French visa? Any other gotachas I should plan for? All answers, especially from senior members, are highly appreciated.

No she does not have to get a UK visa first.

Once you are in France and a qualified person exercising treaty rights then she can apply to join you.

Note that brexit might change things and your and her eligibility under the EU directive.

... also if I get a UK spouse visa and resident BRP card with 3 years visa, would that be enough for us to live in France. I understand Brexit can change lot of these things but I still want to know. Thanks

A UK spouse visa is for the UK only. It does not count for EU countries.

I think after Brexit - both of you will be non EU/EEA citizens and hence you will have to prove that you can live with and support your spouse and/or dependant plus any other requirements you might be asked to provide.
I am not sure you can apply for a spouse visa whilst the spouse is in France already. This visa need to be issued at French consulates. However, if you were first granted residency under EU free movement policy, you might just apply for adjustment - purely my opinion.
