european wants to marry non european

My boyfriend applied from student visa to visa innovator, but was unsucessfull, he appeal but nothing, his only choice was appeal to the high court.Can I marry him and apply for family permit?,in January he'll start a full time course in his college, can he apply for student visa again?.

I am spanish, I came here to live in march-2006, we starterd our relationship in April.He is nigerian, he is working as support worker, he has an MsC degree in plastic and polymeres here in UK+autocad+several courses IT related, he will be 5 years in this country in July-2007.

Sorry for the late reply. You should apply for a "registration certificate" (residence permit) for yourself. As an EU citizen you don't need one to live and work here, it's just a confirmation of the rights which you already have. It's important however if you want to bring in a non-EU husband or partner. When are you planning to get married? If he marries you he can very easily obtain an "EEA family permit", which will allow him to live and work here like any EU citizen for 5 years. After the 5 years are up he can obtain "Indefinite Leave to Remain".

Marco, that is right, but the problem is getting married. Based upon the facts outlined by Etnias, it will not be possible to get a CoA ... Certificate of Approval to Marry ... in the UK ...... and accordingly the marriage will need to be outside the UK.
