Hi friends,

We applied for the UK spouse Visa (Priority Application). Its been 2 months since the biometrics and still waiting for the decision. My income (38,800 and more than 24 months old employment), accommodation (parents) and relationship elements are all fine.

Living apart is killing us. We no longer wish to continue living like this. We both are extremely stressed,
and I am at the peak of :oops: :( PARANOIA and stress.

When you consider financial cost i.e £1600.00 (application fees) +£600 (priority) + £1200 (IHS) + £1750 (Solicitors), £450 (other) PLUS this STREEEES. My heart says enough is enough.

I know someone who is EU citizen and living in the UK who recently got married in India and they applied for the UK spouse visa as a NON EEA wife of EU citizen, did not require English language test, no minimum income requirement, the BIG one is the application is no FREE no IHS and quick decision (within 7 days) and all is free and quick. She got 10 year visa unlike 2.5 +2.5 years for spouse of UK citizen. Why punishment for UK citizen? Because they can?

God forbid but what if our application gets refused by UKVI? We are not prepared to live apart anymore.

My question is can I still go to Republic of Ireland (Dublin) (before 31st October 2019) and exercise my EU rights? And If I move to Dublin how soon can my wife join me there as a spouse of EU citizen?
I am under massive amount of stress, going to Ireland means I have to leave my old parents, family members, and resign from my well paid job in the UK.

If UK Govt do not appreciate my tax and national insurance contributions so be it... :(
I am sorry if what I have written is not appropriate but I had to get everything out of my system. I am so frustrated.

A visa for your spouse to join you in Ireland can take many months. Both Ireland and UK share immigration information and are both very aware of the backdoor approach British citizens try to use.

You also have to prove you have moved the centre of your life to another EU state, ie you cannot maintain a life in the UK at the same time.

Thanks for the reply. I am not trying backdoor approach, I genuinely will move to Ireland for long long time if that means we can live together.
I would only consider moving to Ireland if I my spouse can apply for EU family permit otherwise its no point applying for spouse visa for Ireland as a wife/husband of UK citizen.
I am saying everything because I am very frustrated, otherwise I do not want to leave UK, I love my country very much but its also true that I love my spouse very much as well and we don't want to live apart anymore. :(

I can empathise with you being angry that a priority application takes this long.

Since you used the services of a solicitor to make this application, have you actually spoken to them about this?

On another note, are you actually suggesting that an international move (that would invalidate your wife's ongoing UK visa application since you would no longer be settled in the UK) to a country where you have no family, no credit history, no employment history and that is notorious for delaying visa applications for family members of EU nationals, would be quicker and less stressful than waiting for a while for the result of the ongoing application?

Especially with Brexit coming up I'd think twice. I know a lot of Brits here in Berlin who are horribly stressed out because they don't know what Brexit will bring for them.

Maybe give it a few more weeks and contact your MP for help before quitting your job?

Take a step back, breathe and make the best of the waiting time.

You may also want to read a bit on the Ireland forum - a lot of people, including non-EEA family members of EU nationals, seem to be getting a taste of not being appreciated by the government there.
