Exercising Treaty Rights ??

Post by Kali2014 » Mon Jul 14, 2014 3:51 pm

Hi all,

Let's say, there is a requirement that I must Exercise Treaty Rights for 5 years continuously.

First Question:

If I had exercised my treaty rights, for 5 years continuously in the past ... but I'm unemployed now, for more than 7 months, will the government count my past or present situation ?

Second Question:

Part of Exercising Treaty Rights if you're a student is to have health insurance. I never had that, because I didn't know it was a requirement. Will my student life not count as Exercising Treaty Rights?

And if I were to get health insurance now, will they reject it, saying I should have had it when I was a student?

Thanks everyone!

1. Once you have exercised treaty rights for 5 continuous years, you have PR which is really only lost is you leave the UK for more than 2 years.

2. I'm afraid not, but you could argue that NHS cover was sufficient.
