Hi,I am working for an Indian Company and currently I'm in the UK on tier 2 general sponsor visa.My company has 3 months of notice period.I want to change my job here.If I take another sponsorship and resign from my current company.They will ask me go back to India to serve my notice period and my payroll will be changed to Indian payroll.
Most probably if I deny to go back they will not give my experience letter or p45 form.
Just looking for options.Any suggestions.

Employers have a legal obligation to issue P45 when you resign

You are on Tier 2 General meaning you have been "recruited by a UK" company/subsidiary". Why is there a need to go back to home country when you resign? Is this on your employment contract?
Something doesn't sound right

You will need to resign only after obtaining your new Tier 2 visa(new sponsor) post valid RLMT if applicable. You may travel anywhere and return once you have a valid BRP
Any suggestions I make in the forum are out my personal experience and should not be taken as a legal/professional advise.

Thanks Poper for your help.To go back to India is not written in the contract but I have a notice period of 3 months which my company always try to serve from offshore so that we cannot look for another job here.According to my information,if I take a sponsorship from some other umbrella company and if I wont get a job in specific period,they revert their sponsorship.Also If I take sponsorship from some other company legally I'm their employee now but my current company will not leave until my notice period(3 months)so other sponsorship will get cancelled.Can you please help?
