experience of upper tribunal

hi, everyone just want anyone general opinion. I won my first tier appeal on private life, the ukba appealed against it and have been given permission. Just waiting for a date for the upper tribunal, someone mentioned to me that before the hearing ukba can still withdraw before this. Is this relatively common.

I have no experience of upper tribunal but I'd say it is highly unlikely UKBA will withdraw before the case.

Most judges write their determinations to ensure it cannot be overturned at the upper court.They may have identified an issue of law but the judges at the upper tribunal may not necessarily agree with UKBA point of view and your appeal might still stand.

Get a barrister to help you with your appeal if you haven't got already.

thanks peppekalle, i already have a barrister. Am just pissed off with the endless waiting
