Extension for stay rejected (incorrect bank details??)

Post by Fourth world » Sun Mar 13, 2011 11:57 am

Hi there,

My extension for stay request was rejected because I apparently supplied the incorrect bank details. It took them 8 weeks to get back to me (I submitted it 17 Jan, 2011). I rang my bank (HSBC) and asked if they had received/rejected any requests from UK Border agency and they told me they hadn't. The customer services person from the bank I spoke to told me there would have been a note against my account listing this, but there wasn't. The details I supplied were for my HSBC Passport debit account.

All of me application stuff was returned to me, except for the payment details section of the FLR (M), which I thought was strange; this means I am unable to see where and if I did enter the incorrect details. Being obsessive when it comes to this stuff, I am convinced I filled it out correctly.

In the letter I was told that I could reapply, which I will, but, as my visa expired 28 Feb 2011, I will be classed as an over stayer, I think.

I am going to call them on Monday, but I know they will be unhelpful and probably not answer any of my questions, especially the one regarding the whereabouts of the payment details form.

Do I fill out an entirely new FLR (M) or just resend everything with the new payment details page? Should I use my Visa credit card this time?

To cap things off my wife is 14 weeks pregnant and is having complications with the baby. I don't want to use this as an excuse for a re-application, but should I mention this and put in a copy of the letter they sent me rejecting my first application?

If I am rejected again, can I exit and re-enter the UK on a tourist visa, and how soon after exiting? My nationality is New Zealander.

Could somebody help me with this?

Fourth world.

You can send the same form with a new payment details page as long as a new version of the form hasn't been issued (it shouldnt have been - the current version is dated 29 Nov 2010 and you applied in Jan). Keep a copy of everything you send to UKBA.

Make sure you send up to date bank statements/payslips etc.

It's probably best not to pay by card. there are lots of problems with card payments as you have already gathered. Pay by postal order or bankers draft instead.

Make sure your application is perfect because as you correctly identified you are now an overstayer and you won't get a right of appeal if your applicaiton is refused.

Provide evidence of the pregnancy and the complications.
