Hi everyone, I would be grateful if I can get your thoughts on this.

In November 2016 I applied for leave to remain on two grounds, one being the partner of a British citizen, the second ground on the basis of my British child. In December 2016 leave to remain was granted and the letter that I received from the Home Office stated: “Consideration has been given outside the Immigration Rules and due to your particular circumstances that you have a parental relationship with your British child it has been decided to grant you a period of leave outside the rules on an exceptional basis”.[/b][/b]

I would be applying for a renewal in June 2019 and I would like to know if anyone knows whether applications of this type would be dealt with within the Home Office’s service standard of 8 weeks or it would take longer than this to process.

In the past there have been cases of the Home Office writing to applicants whose applications are based on human right to say that because the application raises human rights issues it would take longer to process it. Someone posted recently of receiving a letter from the Home Office that states “Your application raises issues relating to the European Convention on human rights... As such it falls outside our normal service standards for deciding leave to remain applications. [...] You have requested leave to remain outside the Immigration Rules which are complex in nature. As such it falls outside our normal service standards for deciding leave to remain applications."

We have booked and paid for a family holiday in November 2019 and I am considering that if the application would not be considered within the 8 weeks’ timeframe I may have no choice but to use the Super Premium service just to be on the safe side, but thought I should ask the forum members just in case someone has recently renewed visa based on being the parent of a British citizen child and would like to know how long it took to be considered.
