Hi Board

Good morning, how much in advance an empolyer can apply for WP extension before the first WP expires. My WP is going to expire in Sept 08.

Sorry to bother you again, just to double check with you as you seems pretty experienced about Immigration.

I understand I can apply for FLR(IED) within 6 months of WPExt approval received by my employer. Looking at the following info available on HO website, I am little bit confused. My current FLR expires on 25th May, how long in advance my boss can apply for WPEXT. and then me for FLR IED.

Could you please spare a minute to help me.

For those seeking an extension to an existing SBS, TWES or Work Permit IED, you should apply for further leave to remain no sooner than five weeks before your existing leave expires, and within six months of you or your employer receiving confirmation of your approval for an IED. Therefore you need to ensure that your application for an SBS, TWES or Work Permit IED is applied for within these timescales.

Your employer can apply as early as 6 months before your LTR expires. You can even add a few more weeks if you want to factor in processing time but it's not really worth the hassle. You'd then have 5 weeks before the expiry of your LTR to apply for FLR.

If your employer looks at the Business and Commercial Guidance at:

it says:
Extension applications

120. If you want to apply for an extension to a work permit, you should apply before the person’s permission to stay in this country runs out. Please apply at least one month but no more than three months before this date.

121. If you wish to submit such an application more than 3 months before the person’s stay expires, we will expect you to provide details as to why this is required. The Border and Immigration Agency will only consider such applications in exceptional circumstances.
The employer should apply no more than 3 months before your stay expires.

I was wondering though, how come your FLR runs out in May, but the WP expires in September? Is your FLR for that WP?

A WP/letter of permission should be for an employment for a certain amount of time such as "60 months" or until a certain date such as "25 May 2008". Which one do you have?

I am just concerned in case your employer had a letter that said you had to apply for FLR on an FLR(IED) within six months or before your leave runs out, but for some reason you did not apply.

thanks guys, sorry for the mistake it is 25th Sept. I dont know how it happened. Anyway, is there any way I can apply for FLR sooner than 5 weeks before the current visa expires . Because I will be on holidays during that time.

Can my employer apply for wp ext 3months/6months before the LTR expires, could you please confirm and also is there anyway I can apply for FLR sooner than 5 weeks once WP ext is approved.

As paperpusher has said, your employer cannot apply more than 3 months before expiry of LTR.

You can always try to apply for FLR earlier than 5 weeks at the PEO, explaining your circumstances, but I don't know your chances of success. I used to do mine 3 months in advance about ten years ago :D But then, they didn't have appointments or fees at that time.
