Extention...Points for UK Experience? Senior members pls.

Post by jahangir » Tue May 26, 2009 10:29 pm

Hi.

1. The Home Office guidance about scoring for UK Experience is confusing (paragrapha, 151, 152 etc of guidance notes). Can Extention Applicants also claim 5 points for UK Experience because of Earning.

2. Does anyone know if Holiday pay is also part of earning for the purpose of previous earningl. Anyone who has claimed it or knows for sure.

3. Is it OK if maintenance funds is in current account.

Replies are much needed and appreciated especially if they refer to some guidance notes or practical example.

Not sure why and what the confusion is? the answer is Yes. See below:
Claiming points – extension applications only151. An applicant can claim a maximum of five points if he/she has scored points for previous earnings and those earnings were made in the United Kingdom.
152. We will only award points for United Kingdom earnings if the applicant’s immigration status in the United Kingdom legally entitled him/her to be in the United Kingdom and work here throughout the period during which the earnings were made.

Whats that?

Yes. Look at the pg 35 of the guidance notes.
202. The evidence of maintenance must be of cash funds in the bank (this includes savings accounts and current accounts even when notice must be given), loan or official financial or government sponsorship available to the applicant. Other accounts or financial instruments such as shares, bonds, pension funds etc, regardless of notice period, are not acceptable.

Extention...Points for UK Experience? to push-hsmp

Thanks push-hsmp
1. Guidance Notes para 152 says " if the applicant’s immigration status in
the United Kingdom legally entitled him/her to be in the United
Kingdom and work here throughout the period during which the
earnings were made".... this is confusing. Obviously if a person is
extending his visa, his immigration status was a legal one... This
paragraph could have applied to initial applicants but not to extention
applicants. But you are right, it is clear that extention applicants can
also claim.
2. Holiday pay is 28 days pay for Holiday which every salaried person
is entitled to. However, if you don't avail those holidays, you will
not get the pay. So I am not sure if it is part of the allowance
considered in previous earning or otherwise.

3. Thanks for the information about maintenance funds.

I am indebted for the information. Thanks a bundle.
