I am a nurse working for NHS and I had no clue of the working hours ( extra).it's when I started working extra the bank told me that I am allowed to do 20 hrs a week. I started to keep my limits and was working 19 hrs a week along with my normal 37.5 hrs.
Now they say that I have crossed more hrs over the period of 17 weeks ,which I don't understand .I have also signed the opt out form. And now I can't do bank shift.when I asked the agency how many weeks I am not allowed to work ,they said they don't know.
My question is if we cross over 56 hrs in 17 weeks average...how many weeks we can't work overtime?

Hi.
How did you fill timesheets for the extra hours. ? Week on week it must be 20 hrs a max. For 17 weeks you could have worked 340 hours maximum spread evenly across each week. Never you must have filled a timesheet in bank for beyond 20 hrs in any week or 57.5 cumulative including regular work.

Talk to them and understand how they say you went above the limit when you have worked only 19 hours a week. Incase if you had worked by mistake refrain from doing so in future.

Better do locum over weekends or do 4 days to cover 37.5 and do the next 20 in other 3 days in bank. But make sure no more than 20 any week.

Now for your question. If you have clocked 56 hours over the 340 hours eligible. You need 3 weeks to even out the extra hours and to be within your range. (This is simple math) - But I am not sure how home office treats this situation. Ultimately it boils down to how you are paid and how it is documented. Even if you work more in a particular week you should be paid oly for 20 and carry over the extra efforts for subsequent week payment.
