DE FACTO issues

Post by free_spirit » Wed Mar 05, 2008 8:44 am

Hi Guys

I'm in a bit of a dilemma with my de facto visa, me and my bf have been together for 2 years in May. I am currently in Australia on a Holiday visa. I was looking to apply for the de facto visa soon, before my holiday visa runs out again in middle of May. But we had a big separation for 7 months last year, and this time last year we were still separated for another 2 months. So im guessing that this isnt going to count towards the 12 month requirement that they want. So i now have to wait until the very end of May before I can apply for the de facto, because then we would have been back living together for the 12 months. But im not sure what to do as I'm meant to be out of the country by 18th May, so i either have to go on holiday again, which ive already done once, and i know immigration don't like that, or apply for it just before the 18th May and hope that they accept it, but i know they're really strict on the 12 month period, and if i do it then its 11 and a half months. I basically miss it by about 10 days.

Any advice would be so appreciated, sorry for the essay.
