EU Family Permit for Non EU Spouse.

Hi Folks,
I am a German citizen living in the UK since October 2020 and I have PRE-SETTLEMENT status from 31.12.2020. I have married an Indian citizen on 01.November 2023 and she applied for an EU family permit from India on 04.12.2023 ( as per the step by step Document check in the gov.uk site). We have received confirmation from the Visa decision making centre in Liverpool on 11.12.2023 that the application is prepared for consideration by an entry clearance officer. Now, after 6 weeks we have not heard from UK immigration and we heard from people around that she is not eligible for EU family permit since we are married only after BREXIT or 31.12.2020.

Could anyone please tell me if our application for EU family permit is valid ? If we made an incorrect application , which Visa is my wife needed to join me in UK ?

I am employed full time in UK since I moved in 2020. Any advise is much appreciated.

She isn't.
Spouse visa is what you should've applied for.
