Family Visit Visa Deferral?

Post by khalad » Sun Oct 12, 2014 12:57 pm

Afternoon,

Originally applied for a Family Visit visa on the 28th September at the VFS Sylhet Bangladesh VAC. Family Visit Visa applied for 154 days for a first time visitor to come visit his sister and younger brother and the family in the UK with no previous immigration refusals or travel.

We provided from the UK.
Provided two sponsors for finances. His young brother (retail) and myself (a nurse for the NHS).
Accommodation proof was Council Tax bill and Utility Bill
Provided 6 months Payslips from both myself his younger brother
Letters of Invitations from sister, younger brother and myself clearly stating we will sponsor the entire trip.
Provided certified British Passport copies for all us in the UK
Provided a detailed 7 paged iternary (of realistic stuff eg. going thrope park for halloween, going oxford street for christmas lights turn on's, doing a fireworks night, etc)
My uncle provided the following;
His 6 months payslip he only earns his currency 12,000 taka per month which is about £100 roughly.
Letter from employer confirming time off (3 months paid 2 months unpaid holiday) Start of employment etc...
Bank statements 6 months (activity averaging about 15,000,000 (about £14,000) incoming within that period and out going as well not all at once steadily)
Cover letter provided to explain bank statement as family in the UK send money to him a property he was building. Cover letter also explained salary does not go to bank account (normal for country) and is paid in cash on the 5th of each month. Cover letter also explaining ties in bangladesh.(further explained below)
Land Deeds (translated by notary public to english)
Sale Receipts of Rice produced by his Land Generating him income 20,000 - 30,000 every 3 - 4 months.(translated by notary public to english)
Property Deeds (translated by notary public to english)
Electric Bill for his property (translated by notary public to english)
Print out of a travel iternary of indented travel.
Death Certificate of his father.
His cover letter was in detail of what he intended to do in London and with whom. It also clearly stated his tie to his home country. He has 8 sisters in Bangladesh of some are not married. He stated he would need to be in Bangladesh to "arrange" marriages for them as his father has past away and his the only other male in the house. It also stated his elderly mother whom he needs to look after has to come back to. His proprety, His lands (joint names with his father). His Employment. His sister who is in London her proprety to manage aswell in Bangladesh. ( he also explained his modest 12,000 taka per month and gave a small breakdown of his expenturie. i.e he pays no rent as he owns the property etc) and on his return he would have 3 months salary stacked up and family from London would support of needed.

He also declared that he is seeking truly seeking entry to the United Kingdom for a Family visit with his own blood family. He declared he knows not to work nor have access to public funds and would book a return ticket if visa was granted.

Dont quite know which BHC its being dealt with now as Bangladesh had some changes originally it would be Dhaka now i hear it could be New Delhi India nevertheless with the agonising of waiting and application submitted on the 28th September and the BHC were closed due to public holidays both in Dhaka and India my uncle received a sms from VFS stating the following on the 8th October; "Visa Application Ref no SYLH/xxxx/xxxx/x is under process at the BHC. VFS Global or its staffs have no influence in the outcome of a visa application." thought ok great progress. Then i from the UK phoned the UKVI number on 00 44 1243 217 902 and paid the silly 1.37 per min. Gave them the GWF number and asked them to give me the update. The person on the phone (who could hardly speak english properly has to get him to repeat it several times costing me 1.37 per min) He said on the system it shows your file is with the Entry Clearance officer and has been deferred for further checks. I did ask what checks he said he does not know and to call back next week.

My question do "family visit visa's" get deferred normally? If so on what grounds do they defer and application? and what do they check? Just doing our heads in thinking what we did wrong. All documents are original and legitimate so we couldn't really figure it out.

Once a application goes into deferral are they still obliged to make a descion within their time standards of currently 15 working days?

Other than the sms and my phone call to UKVI no other contact made by the BHC/ECO.

Does this sound like ECO getting ready to type his refusal letter?

(Ps im his first Nephew)

Any information much appreciated.

Have a lovely sunday!

There could be a huge heap of reasons why it's been deferred. Perhaps they want to call the bank to check the statements ... or perhaps ... or perhaps ...

The one key thing to note is that the time line you state of 15 days is advisory - it is not a commitment by UKBA - it never has been. It's a 'it should take' - but then there was an american on here who's spouse visa should have taken 60 days and actually took 6 months. No explanation - just that's how it goes.
