Family Visitor Visa - Incorrect Application (Screwed?)

Post by edwinuk » Tue Apr 28, 2015 1:56 pm

Hi All,

I have been reading the forums for quite some time now and learnt a lot. There are so many people here that are very helpful.

Having said that, I would like to ask a question and get any feedback/opinion with regards to our application.

We have submitted a Family Visit Visa application last Friday for my Mother-in-law and Brother-in-law who lives in the Philippines. Myself (Indefinite Leave to Remain), my wife (Spouse Visa) and my parents who are both British Citizen will sponsor and fund all the expenses for the trip.

My question is, I just noticed on their application that I put my wife's status to "Indefinite Leave to Remain" as opposed to "Spouse Visa" by mistake :(

Basically, we own a business in manila and they are looking after it. My mother-in-law is unemployed and my brother-in-law is a student on a school break. We send remittance to my brother-in-law monthly around 600-1000 GBP. My mother-in-law does not have a bank account so cash is given directly to by my brother-in-law. We explained this on our statement and also advised that we wish to invite them to come visit us in the UK. My father-in-law and my wife's eldest brother will remain in manila to look after the business.

*Forgot to mention that my mother-in-law's medical certificate to show that she is fit to travel but because a metal was installed on her knee a few years back, she requires someone to assist her as she struggles walking long distances - hence my brother-in-law travelling with her.

Documents we submitted are;

For my mother-in-law and brother-in-law;
  -Applicant’s passport and passport photo
-Birth certificates of Mother-in-law and Brother-in-law
-Marriage certificate of my mother-in-law and certificate of no marriage of my brother-in-law
-Proof of medical condition for my mother-in-law inc x-rays.
-Graduation certificate of my brother-in-law from last course and enrollment certificate for november
-Sponsorship form (From parents and us)
-Letter from us confirming remittance (Managing the shop)
-Business permits (Under my wife's name)
-Completed visa application form – VAF1B
-Invitation letter from sponsor (From parents and us)
-Statement from myself and my wife inviting them
-Statement of my mother-in-law and brother-in-law about their intention to visit
-Evidence of accommodation i.e. copy of title/morgtage payments
-Home office letter confirming permission to stay in the UK of the sponsor(s)
o Proof of my Parents citizenship
o Proof of my Indefinite Leave to Remain status
o Photocopy of my Wife's passport/visa
-Payslips of sponsor(s) – 6x Months (My Parents, myself and my wife's)
-Bank statement of sponsor(s) – 6x Months (My Parents, myself and my wife's)
-Letter from myself explaining why I submitted a printed copy of my bank statement with bank stamp
-Bank Statement of my Brother-in-law (Proof of our monthly remittances)
  -Employment certificate of sponsor(s)
  -Family photos
What are my chances and will the mistake on my application with regards to my wife's visa hinder it?

Thanks guys!

I am not an expert, but given that you have provided copies of your immigration status in the UK including your wife's, you will be okay. Based on my past experience, if you are more transparent with your background and intentions, you will not have any problem with the visit visa.

You think so? I really hope they go in detail and consider it as a mistake. What worries me is they always find reasons to refuse you no matter how small or trivial the reasons.

Agree with your point, they do seem to try and refuse if they could find a reason. I assume you provided a cover letter explaining your situation (Immigration status), and you also provided a copy of the evidence. So if you have made a mistake on the application, I am sure they wont mind. Moreover, I dont think your wife's immigration status would affect this application in any way, unless of course she is not a legal resident.

Thanks vignezsh. I guess all I can do at the moment is wait for a few more days. I mean if ever they refuse it on the grounds that I have not provided a proof of her indefinite status I can always apply for a re-consideration I guess.

I will try and get in touch with them tomorrow also although it is a bit annoying as they charge for a phone call of £1.00+ per minute

Got the application corrected and received a confirmation from UKVI last Friday. They have amended my wife's visa to "Spouse" as opposed to "Indefinite Leave".

It's the 10th Day and still no news. Should I be worried?

Yeah. The suspense is killing me!

I sent them an email to see if they can give me a yay or nay. It is a long shot but who knows...

Hopefully I get it by tomorrow! Fingers crossed.
