Family Visitor Visa Please HELP

Hello,

My husband lives in the USA as a legal resident (on a green card) but eventually we would like him to live here with me in England. I came back because I had to go back to university.

Anyway, he has never been to England before as we met and stayed in America for our relationship, which hasn't been too long. We've known each other for over 2 years but only got together and married for the past 9months. So I wanted him to come on a family visitor visa for 6months to ensure he likes it before we do anything else.

I have consulted a solicitor and he said that his application will probably be refused the first time round and we would win on appeal. I am not too sure about this though, the solicitor says it is because of our age (22) but we are dedicated to each other have been since we got together.

Is this really the case?

We have chat logs, skype logs, pictures, (although our wedding was just the two of us because we couldn't afford anything else). I am also working full time now even though I am a student just so I can show I can support both of us. I still live with my mum so I don't really pay rent and she is happy to provide accommodation for him.

Is there anything else I should be including despite the obvious passports, marriage certificate etc. I really want him here with me asap and don't want it to be rejected because an appeal could take months.

Your lawyer is not necessarily wrong but he obviously has been given more information (than us) about your partner's circumstances in order to be able to make informed guesses about the possible outcome of an application. In this case I suggest that it's all about your partner's strong ties to his current location. A person's strongest tie is often his family so having a spouse that lives in the UK may compromise or conflict with any ties he has to the USA. What is it about his situation in the USA that makes him motivated to return there after a visit to the UK rather than simply abandon all of that and stick around in the UK? How he deals with that question and what proof he provides to support this may be the basis on whether he gets a visit visa or not.

well, we do want to get him a settlement visa eventually but he has a job and like you say family there and is taking time off from university to come and see me. Is this proof to show he isn't going overstay his visa?
