few questions re ILR application

Post by deebs » Sun Nov 13, 2011 12:18 am

1. I have been in the UK since Aug 2006. My absences in the UK are circa 225 days, which includes continuous 120 days (30 days in India and 90 days in France). Since this was due to the nature of my job (business travel) would my ILR application be favorably considered if my employer provides a letter?

2. My wife is currently on her Work Permit (WP) and hence not my dependant. I would like to include her as my dependent in ILR application. Is that acceptable? Is my wife allowed to switch from WP to ILR dependant in the UK or will she be required to travel to India and get an entry clearance visa?

Supplementary Qn: If my wife becomes my ILR dependant, will she have to wait for 2 years before she could apply for British passport or could we do it after 12 months considering we have been married and living together since 2008 (though with individual visas and not as dependants)

3. From reading few posts here, I understand there is no need to include my son born in the UK as my dependent (though he is my dependant on my Tier 1 currently) in my ILR application; instead I could directly apply for his British passport after my ILR is approved. Please confirm.

See FAQs for ILR - WP/Tier 1/Tier 2/HSMP holders.
