UK fiance visa

Hi there,

A quick question. I myself are from the UK and my fiance from the US. Im fiance US intends to come over to the UK. We met in 2008, and have been working at this quite some time. I have visited her in the US 3 times and we have all required evidence. I myself currently earn around £250 per week, i just wanted to make sure this is enough. I plan to draw up a Financial forecast to prove we are more than capable of supporting ourselves. I am a University graduate, and claim no public funds. I have a small loan with a bank, would this effect us? and, does debt effect the application?

You need to have £100.95 per week left over after rent, council tax, and debt repayment. Debt does not affect the application but you should mention it in your budget.

Impossible to say without knowing about your housing costs. How much are you paying in mortgage/rent? How much in Council Tax?

Thanks for the replies. Yes we are both over 21. Well, all bills totalled come to around 65% of my income. Once she seeks work over here in the UK, our joint income will obviously be much better.

Right but you need to show proof that you meet the maintenance requirement when you apply. So saying that she will look for work and your financial situation will improve is not going to cut it, unless she has a garaunteed job position waiting for her.

Right, so lets say a loan was taken out. The re-payments of that loan per month would be the thing taken into consideration. If proof is given that these repayments can be met alongside other expenses there should be a problem? Clearly, if a loan has been taken out, and not spent the repayments are not an issue..

The minimum requirement is the same for every couple. If you have children I think that adds another £56/child/week.

No if you're not meant to be repaying the loan at the current time then it shouldn't be a problem. For example, students don't have to pay back their loan until their studies are over so debt repayments wouldn't be taken into consideration if they applied when still going to university as that is not in their current budget.

Yes things that you're currently paying off monthly or whatever the arrangement, you need to mention in the budget.

Thankyou right yes i see. We seem to have everything else in order, however the precise financial arrangements are our key concern really. Im hoping that the Visa doesnt require a Higher income than we can currently attain.

lol, well there have been a whole world of issues that have been in our way. Finances are obviously just one, im guessing other couple have encountered similar problems. This cant be easy for anyone.

Yep there have been plenty of people with the same or similar problems. I think forums like these almost make people go more mental about the whole process and they tend to over complicate things.

Yes, i have noticed that. Some people take a power trip and dismiss others intentions into the groud every so often. However, it seems to be best to know the 'ins and outs' of the process and its requirements. (which seem to be never ending)

oh another point lets say i got another job, a job with a higher rate of pay after i had set the application off. Would i be able to ammend the application? and add the new found incoe onto the existing budget?

Yes you could but do it quickly and make sure you have a letter from the employer. I don't know the address or procedure for doing this. Hopefully someone else with more info can explain.

One thing to keep in mind (and I suspect I'm preaching to the converted here ... but ...):

A fiancee visa is to allow you to marry within 6 months. It doesn't permit the applicant to work.

You also have to then allow for the time that it takes to get the FLR(M) visa before your (now) wife can work.

Our FLR took about a further 4 weeks after the application was sent off (which was a couple of weeks after the ceremony)

That meant (in our case) that my fiancee was unable to work for 5 months of the 6 - and since we then went on honeymoon - it was actually 8 months before she found work.

I just mention it so that you don't bank on being able to count on her work as income.

You also need to ensure you have the funds available for the FLR(M).

Right, yes thankyou. I had taken that into account. I suspected a duration of around 4 week, thus shall be allocating funds to cover myself for around 6 - 7 months of unemployment for my Fiance. Nonetheless, thankyou for the info its very useful to hear a Fiance Visa case. :-D
