fiancee visa

Hi,

if someone got married unofficially (such as religious marriage or islamic one that was not registered in that country), is he able to apply for fiance visa? I am a bit confused as they are somehow married but officially not! So what happens if they apply for fiance visa? Is visa office going to say you were already married or the fact that they did not get married officially is ok and so let them apply for fiance visa?

If it's not official or recognised by the laws of where it was held the you can not be stated to be married.
