First entry after T1G - start counting 28 days rule

Post by spfc » Thu Feb 17, 2011 11:30 am

Hi all,

I got my t1 visa which starts in March.

I will be in Europe in March and I am planning to go to London for a 1 day trip only to have a job interview and check a couple of houses to rent. I will leave UK same day and plan to go back and settle only 1 or max 2 months later.

As per current rules, this date would start counting as my first entry after getting visa which would be before 28 days after start validity date. Do you think they would consider this when I apply for ILR after 5 years (let's say rules won't change) as I am staying less then 1 day (I would get there in the morning and leave at night)??

Cheers

Assuming you do not any other UK visa that qualifies for settlement, your ILR count will start on the day you first enter on your Tier 1 (General) visa.

When you leave (for any reason) and subsequently re-enter UK at a later date, the gap will be an absence from UK similar to any other usual absence from UK (when assessing qualifying residential requirement for settlement application).
