first tier and appeal laws

Post by scorpio1 » Thu Jan 19, 2012 3:43 pm

Hello everybody,
I was wondering if someone has knowledge on following scenario and give some more details. Comments are welcome.
My one friend submitted general visa (6 months visit) application and refused without any appeal. Later (3 months time) embassy issued appeal form with same refusal on based of human right breach.
He posted all appeal form with proof to UK first tier tribunal address but later first tier tribunal told him there is no right of appeal so they will not take any further action in appeal.
I asked friend to get SAR from home office and he received report last week but Iwas really wondering his all appeal documents with evidences are in UKBA database even judge dismiss appeal in initial stage. I can understand first tier should forward all bundle if appeal go to front of judge after validity.

So my query is did first tier tribunal was right to forwarded those evidences to ukba even without any consideration appeal?

If yes then under what article they can forward any idea?

Thank you in advance.
