FLR(M) application date

Dear all,

My wife is currently in the UK with me on a student visa due to expire in early February.

I am currently employed (having been a full time student last year) and will have met the 'employed for 6 months' financial requirement at the end of February.

Unfortunately, this means there is a window of basically a couple of weeks during which my wife's student visa will have expired and I won't have been working for long enough to meet the financial requirements of a sponsor.

The guidance on the website states that FLR(M) applications must be made 'before your current permission to stay expires'. On the other hand, the page confusingly also says that:

"You cannot apply to extend your leave to remain if you are in the UK... in breach of the Immigration Rules (a period of overstaying of less than 28 days will not be taken into account)"

Does this mean my wife can overstay her visa for a couple weeks, thus enabling me to apply after I've been in my job for six months??

Any help would be greatly appreciated.
