Hi guys,

I posted in October 2015 regarding my bf and the refusal of his uni to apply for a tier 4. I was advised to go for a FLR (FP).

I was 21 at the time, full time employment with a salary of £21692. We applied at the end of October 2015. We have received our documents back and a lengthy letter explaining how and why it was refused. They are now saying he has to go back to Pakistan and then appeal. I will try and upload the documents later on once I get my hands on them. Just to give a bit of incite they have said due to us not being married or having children we don't qualify for partner, apparently because we are not living together currently (we explained this extensively due to my work and his uni) we have also been declined. We lived during uni for 3 years together and have been looking to move in together during the past few months - even have a viewing tomorrow and now we have received the bad news :( His health has also deteriorated, since the passing of his father, and random blood tests have now shown he probably has a haemoglobinopathy as well as a very unstable leg. We even stated the issues in the application saying that the incredible progress he has been having with his leg will be undone if he has to go back.

I feel as if the main points were overlooked in our case. We have been in a relationship for 5 years and now that is going to be destroyed. Im at a loss right now because I genuinely thought that it would be a simple case, we gave every piece of evidence, photos, train tickets, references, letters, and even highlighted every last piece.

What should be the next course of action we should take? He is going to visit a immigration lawyer later today but any similar experiences and good news at the end?

I seriously need some reassurance that it it will be alright. Prayers would be welcome.

Why was the appeal certified?

The decision maker ought to have given a reason for issuing the certificate.

Failure to do so will result in the certificate being overturned on Judicial review.

I see no reason for the certificate in the circumstances of your case.

The lawyer has advised that he go back, i go with him and we get married. We will then apply for Spousal visa after I overcome my probation period at work and officially am employed for 6 months.

It states that if you have been refused previously then it will take longer for your application to be determined. Is that applicable to us?

Does this seem like a reasonable plan?

Does not seem reasonable at all. The lawyer does not seem to have a clue what they are saying..

The focus ought to be on challenging the certificate. Not talking about probation, which in law does not even apply to partners.
