FLR(FP) refused with out of country right of appeal

Dear members I need some good advice regarding my immigration history please try to help me out.
I came to uk on student visa in 2010 finished that course and extended my visa in 2012,due to some problems I couldn't attended the uni and the leave have been curtailed on 07 june 2013,applied FLR(O) on 07 june 2013 and got refusal in sep 2013 with full appeal rights, got married to a british national in dec 2013,withdrawn the appeal and applied FLR(M) ON 10 FEB 2014,got refused in 07-07-2013 with out any appeal rights on the basis of interview, applied for judicial review on 20-08-2014 got refused on 28 may 2015,then with in 7 days applied for the permission to appeal from the upper tribunal,on 14 aug 2015 sent a new application on ukba which was FLR(FP) and that also got refused on 10-nov-2015 and given same explanation which was given in flr(m) with out of country right of appeal. And In between on 25 august 2015 they have served me a notice of removal and asked me to report to a local police station every other Monday.so my main question to you all is if I go back to my home country with in 28 days of the flr(fp) decision will I get ban for some time or can I apply for a spouse visa ASAP, My solicitor is saying I wont get any ban as I am changing the visa category,Please reply thanks very much.

If there has been any deception used (implied that you were refused because of interview), I am of the opinion that your status will never be regularised unless the original reason for the refusal is overturned, ie you convince them that the interview did not throw up the flags they say it did!
