FLR or Tier 2 Pbs dependent?

Post by ttt_nnn » Mon Sep 29, 2014 10:10 am

Need help in taking a quick decesion..pls reply

My details and my spouse details are as follows

1. Entered UK with Tier 2 ICT long term on Jan 2011.
2. Changed to tier 2 ICT dependent on Aug 11 2012 ( outside UK)
3. Extended tier 2 ICT dependent on April 2013 (inside UK)
4. Extended Tier 2 ICT dependent on Aug 2014 (inside uk)
5. Current visa expires on Oct 2015.

My spouse got ILR on Sep 25 2014. Though my daughter came as my dependent in jan 2011 and changed to my husbands dependent in Aug 2012, she has got ILR along with my spouse.my second kid is born in UK.

My queries are

1. Can I stay as tier 2 PBS dependent without changing to FLR?
2. If yes, can I travel outside UK and enter UK without any issues?
3. If yes to question 1, can I extend the Tier 2 PBS after my current expiry?
4. If I can extnd tier 2 PBS, will I be eligible for ILR by Jan 2016 or Aug 2017( my actual entry to UK is jan 2011 with tier 2 ICT or should I consider the date which I changed to dependent i.e Aug 2012)
5. If I cannot extend my tier 2 PBS dependent visa or if I cannot travel outside the country, then I prefer changing to FLR (m). In this case when will I be eligible for ILR?

You can stay under PBS dependent as your husband obtained settlement under PBS.

I am surprised that your first child was granted ILR, when you had not yet secured ILR. Seems like someone applied the law wrongly, to your advantage, I must say.

In August 2016 you will qualify for ILR.

The child born in UK can be registered if born after your husband secured ILR, or will be a British if born after your husband secured ILR.

You are fine to travel in and out.

You application that was approved in August 2012, was it made before 9th July 2012?

Thanks for the Reply.

Regd my PBS dependent,it was given after July 2012,i.e Aug 11th 2012.So when will i get my ILR? is it Aug 2017?

I got Tier 2 ICT in Jan 2011 and was in UK till Jul 2012.In Aug 2012, I went back to India changed to Tier 2 Dep and came back within 3 weeks. Will this period (Jan 2011 to July 2012) will be consider when calculating my ILR???
