FLR(M) Voluntary severance/redundancy

Post by Rowena » Wed Jan 19, 2022 7:12 pm

Hi all

My husband is on a spouse visa and we are due to apply for his second FLR(M) in April as his current visa will expire on 6th May. We were relying on my employment to meet the financial requirement because I earn well above the minimum threshold on a full-time permanent contract and have been employed by my employer for over 10 years. However, we are going through a restructure and I was told last week that my role is being deleted and I will be competitively matched to another role. I have 2 options:

• I can apply for voluntary severance (which I'm inclined to do) and my end date would hopefully be around mid-July and I'd receive 3 months’ salary when I leave or:
• I can stay and go into the redundancy pool (I'm pre-empting that I won't get the role I'm competitively matched to) so I may get something else

If I take voluntary severance I need to decide by 21st Feb and if I stay on to try and get another role the interview would be around March time, if I don't get anything then I think I'd still be leaving by mid-July but with approx 10 weeks’ salary. If my employment ends in July I would plan on getting another job but I would probably start looking in April rather than have something secured by then.

Although, either way, I should still be employed in April what I'm concerned about is the employment letter as I'm not sure my employer would still be able to state that I'm on a permanent contract by then in either scenarios. So if they can't and they need to add an end date of mid-July would the Home Office have a problem with this if we submit the application in late April/early May? Would we still meet the financial requirement?

My husband cannot meet the financial requirement as he's only been doing a bit of ad hoc part-time work (that would not meet the financial requirement) because he looks after our daughter (who is a British national) whilst I work full-time.

Thanks in advance
