Free Irish visa?

Hello, we want to apply for an Irish visa for my parent. the applicant is a parent of a non-EU family member of an Irish citizen residing in Northern Ireland and resides with us in NI. We need the visa for convenience of travelling to/from holidays from Dublin airport or occasional trips to Dublin / coast. I myself got the visa last year for 5 years.

We believe that my parent, by virtue of being a parent of a non-EU spouse of EU citizen, is a beneficiary of Directive 2004/38/EC, and my parent entitled to a free Irish visa as stated here (https://www.irishimmigration.ie/preclea ... exemptions).

The EU citizen has been living in Northern Ireland for some time, since before Brexit. This has been proven in the court when UK, then within the EU, refused me an entry clearance and which was overturned on appeal. That judgement clearly establishes an EU citizen was exercising her treaty rights for more than 6 months. I am not sure if this is material, but I believe that establishes that an Irish citizen in this set of circumstances, would be trated more favourable as a regular Irish citizen living in Ireland and not exercising her treaty rights.

Embassy told us that my parent needs to pay for visa. We believe she does not. Any advice? That link on irishmigration is my foundation for this argument.

Hi,

Unfortunately Northern Ireland is part of the UK and they are no more in the EU so the EU freemovement directive doesn't apply to your parent.

Your parent need to apply for the agreement between Ireland and UK regarding UK citizens and family members moving to Ireland.

Well ending the Free Movement Directive is the single biggest point of having Brexit. So yes, the embassy is right.

OPs parent is not trying to move to Ireland, but just get a visa. So a tourist visa is the best way forward, I suppose.
