Freelance work

Post by Nikgupta » Wed Sep 15, 2010 9:36 pm

I am in UK from Nov 2009 on Tier 2 (General ) visa. I am planning to switch to Tier 1 General (HSMP) . I have done freelance work in India
for 10 days in May and 12 days in august 2010 and the amount is credited in my bank account by my employer. Can you please let me know if I can apply 5.3 uplift ratio considering it is only for 10 days in that particular month ?

People may be able to answer your query if you share whether you did this work "in India" while you were physically present in India or from UK itself.

You cannot use uplift ratio if you were in UK and claiming for India work.
Also if you are on Tier -2 you need to see if you can work part-time legally ( i know you can with some limit ).

Make sure your paperwork is solid (3-5 evidence) for your part-time job .. since you will be submitting ur application in UK .. expect some delays as they would in most probability have ur PT work check in india .... i would have if you get points without it then do it ..even if it requires waiting ... it is not very easy to show parttime job (you need to show u paid tax, invoice from client, etc) .. PLEASE refer to other threads as there are lots of on topic

Thanks for your reply. I travelled to india to carry out this work. The tax is deducted at source . I have salary slips (which shows tax deducted at source) and bank statements as evidence.I donot have the Form 16A yet as I will getting it in April 2011 (ie after the financial year ending) . Can you please elaborate what is Invoice from client and I shall check with my employer if they can provide the same.

How can one produce salary slips for "freelance work"? Salary is paid to "employees" of a company and Form 16 issued to salaried employees.

Or am I missing the point?

:?

Form 16 is for salaried employee while Form16A is for contractors who are not regular employees. Can you please let me know if my 10 days income will be considered for the uplift ratio? and elaborate what the 'invoice from client " is?
