My partner is a Sri Lankan national who claimed asylum on arrival in 2014. This was refused in 2015 and appeal rights exhausted in 2017. I am a British citizen and we both met at the start of 2017. I was aware of the fact he was an asylum seeker. However we moved in together the same year. I was part of his fresh claim which was made in 2018 this also included evidence relating to his asylum claim. His claim was refused 2 weeks after the further submissions was given. We JR’d the decision and this was withdrawn via a consent order. They should had made a new decision within 3 months from April 2019. We both married in June 2019. Home office were aware of our intention to marry a year before hand. Further submissions were sent to the home office in June and July 2019 about our relationship and marriage. We have had to PAP them twice once in September in which they replied they would give a decision in 2 months. December came and no decision. We PAP them again in December in which they relied last week to say they apologise and we should receive a decision within 2 weeks on the reconsideration of their decision.
When we made the further submissions I was not earning a the minimum requirement of £18,600 I was earning £17,000.
We want to know what’s the likelihood that some kind of leave will be granted Possibly outside the immigration rules using their discretion?
