Full time single dad and immigration

Post by fromdublin » Fri Nov 19, 2010 12:19 am

I am married to Irish national feb2006, Stamp-4 since April 2006,
Separated for nearly three year now. Have court orders for son custody, claiming single parents and working community employment.
Other party has access only for one overnight a week, already told immigration department. My visa is up in April 2011, not getting maintenance, I am the dad and non eu.

Need suggestions

Thanks

I have a sort of similar situation with regard to separation (no kids though). I contacted the INIS spouse section and I was told to write to INIS explaining the situation and hope for another stamp 4.
I would imagine they take into consideration how long you were married, employment, your ability to not have to depend on the Irish state for benefits, etc
I would advise you to contact them as soon as possible as we all know they're not the speediest when it comes to sorting out situations such as yours. (funnily enough, the INIS guy who replied to me suggested I write to them a month before my stamp 4 expires, but I'll be writing to them about 6 months beforehand)

Yes that is correct. In fairness, the Married Irish Section is faster. Most people should be ok, provided that there was a subsisting marriage for a decent period of time in addition to time courting
