Post by staybless » Thu Jul 21, 2011 9:20 am

I wpould like to submit further submision but the person who accepted me to stay in his house for free refused to give me a ketter to show my proof of accomodation. Is there any alternative to this?

For my refused legacy. My legacy case was refused and i submited a reconsideration letter with all supporting evidences. but UKBA reply to my letter saying that they cant accept further submision by post and that I have to book an appointment to submit them in liverpool. They gave me a list of items to bring. I only ask for reconsideration and they said now for me to go and do further submission. I am confused.

as per the guidance i have linked to above, yes they can require you to attend liverpool to make further submissions.

Is it a positive news for them to request me to do further submission after they have seen all my evidences in the reconsideration that I sent? The most important thing is that they returned all my evidences saying I have to submit them in liverpool.

no it is not positive news, it is just a standard reponse as all further submisions for failed asylum seekers should be submitted in person.

Why did they consider it to be a further submission when I only requested for reconsideration of my refused legacy case? Is it because of the evidences that I submited and they think that I could do further submission?

you didn't just ask for reconsideration you submitted new evidence/information and according to ukba policy they can require that such information is submitted in person. As advised above this is not an indication that your application will now be successful. You should consider seeking legal advice.

I was not aware that proof of accommodation is required for legacy application. However if you supply all the information requested as well as proofs such as bank statement or G P letter, that may suffice. What was or were the reasons for rejection, and which evidence that were not provided before, that you are intending on supplying now?

I sent refrences letters from neighbores, cousin, the child minder, friends nd the child mother to ukba requesting for reconsideration and they returned them back to me telling me to submit them in person in liverpool. I think there is a diference between a fresh claim and further submision. The evidences that I submited is to show that I have a bae of staying in UK

any evidence submitted after your first initial claim was refused and had all your appeal rights exhausted is treated as further submissions and its got to be done in person. the decision maker will consider the evidence submitted and if rejected, he will then determine whether that new evidence amount to a fresh claim. the submissions will amount to a fresh claim if they are significantly different from the material that has previously been considered.

when you enter the building you will be issued a ticket with a number. you will be told to sit down and wait for your number to be called. you will be asked to confirm your address and they will ask if you are reporting at the present moment, if you don't report you will be issued with an is96 form after a few days of submitting asking you to report at your nearest reporting center. depending how many people are there, but handing over your submission at the counter takes only a minute.

has there been any news from Liverpool? I was wondering, when they refused your legacy. Did they actually asked you to send the references? or you just sent them on your own to make your application strong?

im a guardian of this family, whose legacy case was refused and there hasn't been any reply since then. the lawyer has sent a reconsideration but he never asked us to attach any references. the family has been here for 10+ years now :-/

thanks

I haven't heard anything from liverpool about the further submission. i was requested by CAAU to do further submission as they refused to accept my reconsideration letter and supporting documents by post after my legacy refusal.

To my surprise, I received a recorded delivery letter three weeks ago which is a reply to the reconsideration letter that Iwrote last year. They just said that they aresorry that i am dissatisfied with the way UKBA handled my case and they are applogising on behalf of UKBA for the delay in replying to tjhe letter. They went on to say that they can not tell me when they would deal with my case but the would see to it at the earliest opportunity. They didn't say anything about the further submission.

I wonder why they sent a one page letter like that through DX delivery?

My reconsideration was refused because UKBA do not accept further submission by post anymore. I received a similar refusal letter to yours. UKBA requested me to submit it in person in liverpool which I did.
