Garden leave. Final date of employment

Post by MrHello1 » Mon Mar 04, 2019 4:52 pm

I am currently on a Tier 2 ICT visa and have just commenced Garden leave that ends on 18 May. Am I correct in saying that this date will be seen by Home Office as my last day of employment and the 60 days leave curtailment will apply from then?

My employer has advised HO of the situation, I am just hoping the 60 days will apply from 18 May and not today (4 March) when HO was notified of the change of circumstances. Any insight is appreciated?

Make sure that your employer has not notified the HO in a manner that suggests you have not been terminated - if they have your clock will have been potentially started.
Your 60 days curtailment does not start until you receive notice from the Home Office. That could in itself take months.

When does your actual visa expire?
