T2 General Made redundant

Post by Nomi-UK » Wed Jan 28, 2015 4:20 pm

Hi All,

I am on Tier 2 general visa and recently my company made me redundant and i have asked the HR not to inform UKBA that i left the job and they agreed on this. They told me that, we will not inform UKBA about your status your COS will be the same state. Now,i have a T2 visa until 2019 and actively looking for any other T2 based role. I need to ask some questions from the experts which are as follows:

1) let suppose in worst case scenario, i got a job without sponsorship and i have completed the period up-till 2019 which HR already agreed then after 2019 i will be eligible to long term 10 years residence ILR application in which UKBA will check only my legal status. If the sponsor didn't inform the UKBA then how come UKBA will know about my legal status ? if they don't have other way then i am eligible to apply long term residence ILR i guess ? any thoughts on this please ?

2) If i get a Contract base or permanent job and carry on working with them under old employers sponsorship then can i eligible to Tier 2-ILR route instead of long term residency. My friends and colleagues told me that 5 Years Tier 2 to ILR route is much more restrict and in this application they will check pay slips and all stuff but in long term residency they will check my legal status only.

Ideally, i am looking for a tier 2 sponsored employer if i am not able to find Tier 2 based job then i have only this option to spend remaining years please assist me on this.

Your employer has to report this to home office else they risk loosing their licence. Home office undertake various checks regularly and it'll be difficult to escape.

It's illegal to work in UK without sponsorship. If you manage to somehow work without sponsorship intil 2019, your ILR will surely be rejected.

This setup is illegal as well as per current Tier 2 rules. I doubt any genuine organisation will agree for this setup.

I would suggest concentrate your efforts in finding a genuine Tier 2 sponsor rather than finding ways to circumvent the immigration rules.

many thanks for your information. I will try my best to get a visa from Tier 2 employer.
Could you please highlight other regular checks which UKBA does on a daily basis.
I know one friend who got 10 years long term residence visa through this Tier 2 route. As per my research, UKBA completely relies on Employer only.
