Asylum interview

Hi my case is quite complicated. I came to UK in 2006 as student. Studied until 2011. Applied for psw but was refused because the qualification didn't meet the criteria. My husband was an asylum seeker but was refused with no right to appeal in 2012. All the fresh claims and further submissions were refused as well. My ARE in 2012 as well. Overstayed!! I claimed asylum in November 2016 as problems started back home for me. (Husband's on going case) I went to the Second interview in Croydon last week. The interview last for less than a hour and only few questions were asked. Anyone had same experience?? Was this pre planned for refusal?? Pls help
I have 3 UK born kids age 10yrs+, 6yrs+ and 2yrs. I have applied naturalization for my eldest and done the biometric. I also have a pending LTR appeal since July 2016

I think you will get leave to remain on the bases of children and if you your child get British citizen then 100% chance.

My story is same like you but my asylum case run for 5 years . Appeal rights exhaust in April 2017 and made further submission in August 2017 , on asylum and child 7 years old

Hi Munir, thanks for your reply. Yes I'm waiting for the certificate. What's confusing me is the questions !! Only about 35questions were asked in total. When my husband made further submissions in 2015 base on Article 8 (child was 8 yrs ar that time) they refused it saying we can go back as a family unit. I don't understanding what's going on.

But that time your Husband need to challenge that decision in court. Ho will refuse your asylum claim but you have 100% chance to get 30 months leave to remain base of your children. so be calm. When I gave asylum interview in 2012 it took 7 hours and it was 200 questions and HO refused after two years and courts took 3 years. It takes 5 years in total.

High court 7 years ruling came effect in April 2016 and Ho was refusing every body in 2015 in the base of 7 years rules. So now your child will get British citizen and Ho will not able to refuse because court ruling Zh Tanzania in supreme court and there is no any law to deport British child with parents. So just calm and chill it's only waiting game left for you. Be positive.

Hi thanks again. I'm not sure whether we had appeal rights. The solicitor submitted something else. Actually we were in extreme stress. I had my third baby at that time.
Yes you are exactly right. The solicitor said the 7 yrs is just consideration not a rule!!
It has been one a half months since biometric for naturalization. Hope we'll get it.
When you mean granting, is it Discretionary LTR??

Yes it's discretionary leave to remain, most of solicitors are only money making and they don't know what to do and my solicitor are also same but I was pushing him every time , I know the rules and I worked in court since to 2009 to 2012 as court CLerk. so don't take stress and your good days is coming. If you struggling for money to live then apply for asylum support.

Oh I see, that's why you have knowledge about these immigration matters!! That's true. We've been to more than 7solicitors now!! When his further submission refused we wanted to go for a JR. solicitor Sent a pre action letter then the HO wanted more documents but the solicitor didn't inform us about this.
Meantime a person from HO Sheffield called me (early 2016) and informed that he's gonna grant us LTR in the basis of my 7yr old child. He sent us a letter asking for original dox so we sent everything. He called me again asking for my husband as he noticed the same father's name in all 3 birth certificates. I didn't want to lie and said he's living with me. Then I received a letter from a removal officer asking for more dox. I prepared a 400page bundle and this was refused in 3days. I think he didn't even go through this properly. I went mad when I read the refusal. Wrong information cut and pasted here and there!! He even said that I have given birth for 3 children thinking that UK is my home!! We have appealed and waiting for hearing.
Now about the Money, I'm from a well off family back home and my parents were helping me. Following an incident( reason to claim Asylum) my father had stroke and now unable to carry on the business so I asked for support. It was granted last April and we were sent to a share accommodation in London.

so you will grant visa but its waiting game , you lost 7 years case because of your solicitors

So true!! But this time I prepared everything. I tried to contact the solicitor after my interview as they gave 5 days time for any amendment. Still couldn't!!

you need to sort out interview amendment within 5 days so do on time , push your solicitor to do on time

Hi Munir, hope you are doing good. I couldn't contact the solicitor so no amendment was done. As only limited questions were asked there were no complications I guess. Anyhow a person who's working in a solicitor firm told us the HO will anyway refuse the case and we can only win in courts. Any idea??? Im confused!!

If you get your child British certificate then send straight to HO and you have very good chance to get. Discretionary leave to remain

Hi Minor, I received a letter today from Next Generation casework asylum asking to confirm my address for myself and dependants, so they can proceed with my claim. This is the same address HO currently using for correspondence ( my interview, support etc.) And what is next generation? Is a hired company??

Hi , I received letters for bio metrics for my self and dependants. They have asked for pp sz photographs as well.

Congratulations you are going to grant within 3 to 6 weeks and did you get biometric by Royal Mail or DX and it's signed for or 2nd class?

In most of asylum cases if HO want to grant then Ho invite for biomatric

Is that so?? I was wondering whether this is a normal procedure. Did you do your bio metrics after 2nd interview?? My husband cannot remember as his interview was in 2011.

I never had biomatric yet and most cases in asylum people got grant after biomatric invitation and did Ho gave you 5 working days for biomatric enrollment?
