Hi all,
I wanted to give an update on my timeline and the HO response to my MP on my request to return the travel documents and BRP. I have informed my solicitor with the outcome and he said that the HO is obliged to give an answer to the MP query but MP's can't force them to send the travel documents back. And this response from the HO is standard nothing to worry about as the ILR has already been granted to me by the FTT and the decision is not challenged by the HO. In fact, I have received the Implementation letter from the HO as well.

Please see below the standard reply from the HO. Hope this will help others with the similar situation.

Thank you for your email correspondence of 12 February and 20 February with attachments on behalf of Mr (------) of (-----, about the return of his travel documents.

On 15 November 2016, Mr ---- submitted an application at Croydon Premium Services Centre for Indefinite Leave to Remain (ILR) on the basis of long residency.

As you are aware this application was refused on 16 May 2017, with a right of appeal to the First-Tier Tribunal which Mr ---- subsequently exercised, and his appeal was allowed on 30 January 2018.

I understand that Mr --- is concerned about the length of time it has taken to make a decision on his application. It would be helpful to explain his application for Indefinite Leave to Remain is subject to checks that must be completed before a decision on his application can be made. As such, we are unfortunately, unable to provide a timescale as to when a decision is likely to be made.

Regrettably, it is not possible to return original documents, including passports, until we have completed all work on Mr ----- application.

Please assure Mr ---- that we will notify him as soon as a decision is made.

Hi all,

I am waiting for my BRP after long battle.

A judge letter to allow my appeal was posted from Tribunal on 14 Feb.2018.
Since then, I haven't received any post from Home Office.
(I asked to Tribunal that HO doesn't challenge against the Judge's decision :D )

Anyone knows the contact address of HO where writing to? I want to ask them to send me back my documents and to issuing my BRP :)

Congrats, the current waiting time to receive BRP after a successful appeal is between 3-4 months. The standard time is 90 days once you received the implementation letter from the HO. You may be lucky if you receive something before that.

I have been reading this forum for a while and have been finding comments here very helpful during my long visa battle. It is ridiculous how long HO are taking to make decisions and how little information there is out there.
so I just wanted to share my story hopefully others will find it helpful. I can see some people here are in the same boat.

I have applied for ILR based on 10 years long residence via same day appointment is Sheffield in September 2016, little did I know that this appointment was gonna turn into an almost two year wait.
My ILR got refused with the right to appeal, so I appealed in October 2016. After an excruciatingly long wait I finally got a letter to notify me of my appeal date in July 2017 (so almost 10 month wait) my appeal date was scheduled for January 2018. I won the appeal and got a letter to notify me early February, then got a refund of my tribunal fees 2-3 weeks later. Since then no news so I am still waiting. Already made some travel plans for the summer so hoping and praying things will get resolved by then and I can finally get my life back.

So to summarise:

September 2016 - ILR refused
October 2016 - I made an appeal
mid July 2017 - appeal hearing scheduled for Jan 2018
late January 2018 - court hearing
early February - court decision letter
mid February - trubunal fee refunded

So its already been like a 1 year and 7 months wait and from what I understand I will be waiting another 2 months at least if I get lucky. Would really appreciate if someone with similar timeline would get back with their developments and how long it took them to get BRP after successful appeal? It makes waiting a little bit easier when you know what to expect and when. I really can't wait to have my documents back already.

Hi Anya,

My timeline is similar to yours. My 90 days after appeal allowed are completing on 19th of this month after which I am planning to launch a complaint. Nothing from the HO yet as I have tried everything. You can see my previous posts.

We can only wait but never give up.

By the grace of almighty, I have received my BRP today a long battle of 9 months is over, I also have received a letter from home office that your passport and sporting documents are sended to you in different envelope, which I will receive in couple of days.... ooh god it was long time but it’s over, a nightmare is over in the end. To be honest I am really looking forward to your outcome. Please keep your high hopes and let me know about your outcome. You will get your good news very soon

Hello Guys,
Does anybody know if any comments on here also apply to allowed asylum appeals?My asylum appeal was allowed on March 9th but since then i've not received anything from HO yet. Could somebody suggest me a way??

Thank you so much I got my brp on 17 April and couple of days later I received my all documents back including passport and inshallah I going back home on eid ul fitar
That letter was not actually apology letter, they requested me to be patient and wait until we complete all necessary checks and requested me for not lunching j.r but I proceed court took some time to lunch jr and notified both parties and given 21 days to submit reasons of delay before 21 days over home office issued me visa and returned my documents

My appeal was allowed 22 February Receivef acknowledgment letter 2 may how long will take to get visa 🤔 I m waiting since September 2015 and Home office hold my passport

Hi

After reading some of your replies I’m assuming I’m one of the lucky ones (well only in terms of receiving my visa after a successful appeal - the rest I’m not quite lucky with as I was born in the U.K. and shouldn’t have been in this situation in the first place).

Long story short it took almost 2 months after my successful appeal to me actually holding my BRP.

I had my appeal on the 21 March 2018

The judge sent his successful decision to me and the HO on 9 April 2018 (I didn’t receive my award fee back which is ridiculous but anyway)

The home office sent me a letter of acknowledgment and told me to pay the IHS (health surcharge fee of 500 - which is also ridiculous) on the 20 April 2018.

I paid it on the 24th April 2018.

I received my new BRP in the post on the 11th May 2018 (although the date on it is 9th May).

This whole process has been a long and emotional one so believe me when I say I’m just happy to have received it and I can finally travel to visit my loved ones.

My whole story is a bit long winded but I thought I would write below the full story if anyone wasn’t to read it as when I was initially rejected in 2016 it was a very distressful period and reading a lot of information on this board really helped me visualise what was to come so I just want to give back and do the same

I was born in the U.K. in 1995 to Nigerian parents (right after Margaret’s had passed the law that being born here does not give you automatic citenship) but since I went back to Nigeria before I was 5 and came back when I was 11 they would not give me permanent residency so i had to start again using a student visa (even though all my siblings are british citizens - I know - stupid.)
I applied for ILR In November 2016 (10 year route) as since 2006 I had now been in the U.K. for over 10 years as a student.
In late 2011 we were scammed by a group of fake solicitors ( called U.K. visa and immigration - ash shadat back then - which you can find articles about him on bbc. He took money from so many people and never gave them their documents back) and they stole our documents and bribed us for money. I couldn’t process my student visa in time and eventually involved the police. Got my documents back and processed a new student visa in September 2012 which was successful.

Fast forward a few years into 2016 thinking the home office would have understood that it wasn’t our fault and pass it as a compassionate circumstance (because they did in 2012) they rejected my ILR application (with right to appeal) because of the gap in 2012 when I had my documents stolen to them is a break of “lawful residency” (even though I remained in the U.K. that whole year as my documents had been stolen!!!) and they couldn’t pass it off as a compassionate circumstance.

Anyway I’m sure most of you know the process. It’s a waiting game. I applied to appeal - oral hearing. It took almost a year to receive a court date. I didn’t get my court date (of 21 March 2018) until late August 2017.

And then I was successful (as I wrote above) because the judge obviously saw that the HO was being ridiculous.
But unfortunately I didn’t get the outcome I expected. Instead of giving me my ILR they only gave me a 2.5 year FLR and made me pay the ihs which is just ridiculous. My whole family is British and I’ve been here basically all my life but this country’s system is just going down the drains. God knows what it will be like post Brexit.

I’m happy to finally receive something at least so I can finally travel. I love seeing the world and now have a partner abroad so the worst part for me was not being able to just go about freely as I would.
I used a good lawyer but she’s retired now unless I would have given you her name. But to be honest if you have a strong case and the HO were just being annoying as usual then you probably don’t need a lawyer. You don’t need a lawyer for the itnial filing of appeal and the first bundle etc. The judge doesn’t even read any of that trust me. You may need a lawyer to prepare the final bundle before your hearing date but that’s all I would suggest. Try to save as much money as you can. That’s my main advice.

But anyway be patient and I’m sure it will all work out for you. Some times I got fustrated and just wanted to pack up and leave but then they will win. And that’s what they want you to do, so don’t give up.

Hello, My name is Waqar. My asylum apeal was allowed on 09-05-18 after a one year of struggle. and home office is not challenging it. I want to know how long I have to wait for brp.note (Did not receive home office letter yet.)
the point of consern is that i want to carry on my studies which can not be possible just with the court letter of allowed appeal. Is there any way to
Speed up the process. Because one of my friend got his Asylum allowed directly from Home Office and his brp was delivered with in three weeks.

after 3 years of stress I have won my appeal on 24 April 2018, no challenge from the HO, so how long does it take to hear from the HO? It's more than a month now.

Hi Waqar & Nasri follow my previous posts. Im still waiting for my travel documents and BRP after my appeal was allowed in January 2018. I have done all I could. My MP has contacted 4 times some strange responses were received, 4 letters are written by my legal representative but no response. I have provided the evidence of my seriously ill mother as well. Still waiting....

my appeal for EEA RC was allowed on 23 march, its been almost 4 moths haven't heard anything neither implementation letter. i can see few members like me waiting for BRP more than average time. please keep posting update which helps others.
hopefully this long will be end eventually.
