No, the ILR gives you the right to work.

More .... ILR held by a person of any nationality gives the right to live in the UK, and to work.

It took them 4 months to send me my yellow card and 5 for my blue card..

Bulgarian applying for NI number as self employed - refused

Hi

A Bulgarian friend of mine has asked me for some help. He has moved to London from Bulgaria and is self employed. He has tried to apply for NI number twice but he has been refused. The letter says

"We have carefully considered the evidence you provided and, where necessary have made further checks and have decided the work that you do and the way you are engaged to do that work is not considered to be self employment. Self employment is not determined by either your wish to be self employed or the person using your service. This can only be established by analysis of the facts".

After that it just advises how to reapply if his circumstances change.

He is unsure what to do next and where he may have gone wrong with his application. Searching the internet I am finding it difficult to find out what kind of work can be classed as being self employed. Can anyone here offer us some advice on what qualifies as self-employment?

I don't know exactly what evidence was provided although I've emailed him to find out. He is working as a painter and is currently finding work through advertisements. He hopes with a national insurance number he can work as a sub contractor which would pay better.

I guess the question I'm asking is what sort of evidence is usually required? I would have thought some invoices from different jobs he's done would be best to illustrate the nature of his employment. He said he'd asked an accountant to help prepare some documents so presumably that was invoices. I'm not sure what else he would need except his identity documents?

Has he registered the existence of his self-employment with HMRC? If not I suggest that he does that without delay, especially as there is a need to tell them within 3 months of the start date, in order to avoid a £100 penalty.

Evidence of that HMRC registration can only help him getting a NI number.

He is intending to become self-employed, work here and live with me and we have asked for the forms for this to be sent from the Inland Revenue - however, if this fails. I don't want to find suddenly that he has to leave after three months.

Can I ask, what sort of work will he do? And whilst he will be classed as self-employed as defined in the EU Directive, will he be operating his business in his own name, or alternately will he have a Limited Company of which he will be the sole Director and sole Shareholder?

Hi All,

My wife is Romanian. We have been married since June 2010 and she has a NI number and the right to emplyment in this country. She would like to apply for British Citizenship and a British Passport.

We were looking for advice on how to go about it and the potential costs.

We live in Scotland, in case that is relevant.
