ILR on expired passport, should apply for BRP or naturalisation

Post by help2021 » Sun Sep 26, 2021 1:48 pm

Hello Everyone,

I got my ILR in 2011, It was a stamp on my old passport. Currently I am working and getting universal credit as well. recently, it came to my knowledge that, ILR stamp on expired passports are not accepted anymore. My employer was happy to accept old passport and new one together.

Now my question is what would be the best action I can take from here

1. Apply for transferring to BRP (cost £229, and extra £800 for faster service) then apply for naturalisation
2. Apply direct for naturalisation. (will that allow me to continue work/get new job while decision pending)
3. either way, could I be in trouble for working with ILR on expired passport.

thank you for reading and your help

ILR status does NOT expire so you are not doing anything unlawful. However, you need a valid BRP to prove your right to work to employers as per the immigration act 2014. You do NOT need a BRP for naturalisation application. So if that is your intention, apply directly for citizenship as there is no need for a BRP

New employers may require a valid BRP.
