Of course, all they have to say is that your job doesn't exist anymore and your WP is automatically cancelled. If they say the company is being liquidadated, it amounts to the same thing.

If they said they are going to cancel your WP, you should start working for a new job now. Once they have sent the letter to the Home Office you have 28 days to leave the country or else you will be overstaying your visa.
Be careful not to asume they haven't cancelled the WP yet, they might have sent the letter already to the HO, check and count the days or you will be affecting your future chances of getting a permit.

The 28 days count from when the Home Office sends the letter to you, not when the employer writes to the Home Office. It gives a little more time because the Home Office usually don't send it immediately. Sometimes they don't send it at all.

Tom, as regards :-
I mean once they are in liquidation how can they cancel WP as company does not exist legally.
-: do note that a company going into liquidation does not instantly mean it ceases to exist as a legal entity. It merely passes control of the company from the Board of Directors to the Liquidator(s). Those liquidators then need to do what they can to protect and enhance the assets of the company, etc.. That might possibly mean trying to sell off the business as a going concern, or regretfully making lots of staff redundant in order to reduce liabilities.

So in answer to your question, "once company is already is liquidation can the company still can cancel my WP?", is undoubtedly "yes", the liquidators, or someone working for them, certainly has that legal ability.

The company doesn't cancel the WP. The WP is automatically cancelled if the company and the job doesn't exist anymore.

If the Home Office is aware that your job doesn't exist anymore, by whatever means, including a notification from your former employer that the job doesn't exist anymore, they will take action and officially inform you that your WP is invalid and that you must leave the country in 28 days.

That being said, why do you think your former employer will notify the Home Office in the first place? From what you are saying, they appear to be taking a low profile.

In any case, now is the time to move fast and find another employer.

There is no point in deleting your postings.

No one on the forum works for the HO. Indeed the forum is for the benefit of all members so think carefully before removing your posts :shock:
