Seems like the UK government is now trying to close this way of getting into the UK:

On the UK "rules" that saisfy this route, according to one website, the UK government imposes criteria to qualify under this rule that are not in the original judgement that enables people to use this route. Thus, according to the original ruling, they only have to have been in the other country about 6 months, not more, they should not need to show that they have tried to learn the language of the non-UK country and they should really not have to demonstrate than the non-UK country they lived in was intended to be their centre of life.
From that, it seems that (again) the UK government is interpreting this ruling in the most unfavourable way possible to immigrants. Whether the UK interpretation has even been subject to challenge I don't know.
