he is on a flight as we type.

i spoke to him about 5 times today they let him call while they held him in a room in gatwick airport.

i want to arrange to go very soon.

can anyone tell me what happens when he gets to tirana airport? he has his passport so all is fine, do they let him go straight away or is there some kind of process?

good news - he was finally allowed a wash. i certainly recommend talking to communications house if you have any queries - they are great!

they advised me to make a big complaint, because he did not even have a sink in his cell with the toilet - he wasn't allowed a wash since wednesday, no toothbrush, no change of clothes, no water to splash his face - surely this is a human rights thing ?

Is this not relevant:

26.17.4 When does rule 320(7B) not apply? [Updated 9 July 2008]

Under paragraph 320(7C) of the immigration rules, You must also not refuse an applicant under 320(7B) if they are applying in the following categories:

Spouse, civil partner, unmarried or same-gender partner (Paragraphs 281 or 295A);

Fiance(e), or proposed civil partner (Paragraph 290);

Parent, grandparent or other dependant relatvie (Paragraph 317);
Spouse, civil partner, or unmarried or same-gender partner of a refugee or person with humanitarian protection (Paragraphs 352A, AA, FA. FD);
Those applying to exercise rights of access to a child (Paragraph 246);
They were under the age of 18 at the time of the most recent breach of the UK’s immigration laws.

If she applies for spouse visa won't she / he be exempted?
WB,

I would love to think that you're all right and I'm wrong. It was my understanding that Liam Byrne had indeed exempted certain groups.

However I've had several enquiries where removals have been refused entry clearance. It also creates a human rights disparity in the wide swathe of gropus who in effect are allowed to breach the laws until removed, then granted entry clearance. And even more nonsense of the proposed section on selected migration in the Immigration and Citizenship Bill.

vickvickii (or anyone else),

Please keep me posted on this. I expect there to be a lot of ECO reviews if this is indeed a full exemption on the removal issue. It means some of them are still getting it wrong.
Oh, the drama...!

the immigration people told him he would still be able to apply as any normal person.. and my solicitor also said it wouldn't effect him.

i hope so, i really do, otherwise looks like i'm moving to albania.

i will keep everyone posted.

he is in albania now on his way from tirana to has to be with his mum and dad. he is going to arrange the wedding & get lots of info that end while i gather up all of our evidence and get help from my solicitor.
