What do we do next?

Post by colloc » Mon Sep 24, 2018 10:54 am

Hello,
Found some very useful information on here so far and hopefully will receive some good advice.
I have a Russian girlfriend who has a 5 year old son.
We have holidayed in Turkey and Russia together.
She was granted a 6 month ME visa and so far has had a 3 week trip with 2 weeks back home and is now on a 4 week trip to my home in Scotland.
Her visa will expire in January and I am not too sure on what to apply for next.
I have been legally separated for over a year but it could take as long as another year before the divorce is finalised (it all went pear shaped after we parted and that's a different story)
No issues with my income or property.
If we apply for a Fiance visa, we would have to marry within 6 months? not sure I will have the paperwork available in that time period.
Thanks in advance for any constructive advice.

You won't be able to apply for a fiance visa until your Divorce Decree Absolute has been granted.

Does your partner have evidence of sole custody for her child?

Do you earn a minimum of £22,400 p.a ?

Casa,
Thanks for the response.
Yes she has sole custody of her child.
Yes I earn well in excess of 25K.

Unfortunately, you'll have to wait until your divorce is finalised before applying. It may also be easier (and less expensive) to marry outside of the UK and then apply directly for settlement visas for your wife and step child.

Casa,
Is she able to apply for another tourist visa in the meantime?

Yes if she is able to submit evidence of strong ties to her home country, including financial self-sufficiency, in order to convince the ECO that she won't overstay in the UK.

The fact that she has complied with the terms of her previous visitor visas with be in her favour.
